TERMS OF SALES -- ARK DESIGN INC.

CONDITION OF SALE

All purchases must be paid before product will ship. Sales are to be paid by cash, credit card, PayPal or wire transfer. Any purchases made via wire transfer will be subject to a $20.00 bank fee. All purchases made via credit card or PayPal will be shipped only to the billing address or a PayPal verified address. Please note that any bank fees are not refundable. International credit cards are not accepted as form of payment.

LIMITED WARRANTY

ARK Design Inc. (“ARK Design”) products are warranted to be free from defects in materials and workmanship for a period of 18 months from the date of purchase from ARK Design. Any products with visible damage, modified or altered in any way will not by covered by warranty. ARK Design does not warrant or make any representations concerning its products when not installed in accordance with the manufacturer’s instructions or for any installations and maintenance practices not standard of the automotive industry.

ARK Design reserves the right to examine all parts returned for warranty claim to determine whether or not any such part has failed because of a defect in material or workmanship. Ark Design’s obligation under this warranty shall be limited to repairing, replacing, or crediting, at their option, any part found to be so defective, regardless of whether any part is repaired, replaced, or credited under this warranty. Once the product is received, ARK Design will have 30 days to assess if the product falls under the Limited Warranty.

If the product falls under the Limited Warranty, ARK Design will replace or repair the product within 30 days. If upon inspection the product falls under warranty but cannot be repaired or replaced within 30 days, you will have the option to a full refund (minus any shipping costs) or to wait for the back-ordered product to come back into stock.

All shipping charges on the return of such parts must be prepaid by the customer. ARK Design will not be responsible for the package or item until it is received at ARK Design in undamaged condition. We recommend you insure the package to its full value.

If the product is deemed to be faulty or defective and under warranty, we will ship the repaired or new product back to you at no additional cost. If the product is not defective, faulty, or under warranty, the customer will have to pay additional shipping costs to have the product returned to him/her.

ARK Design will not be liable for any labor charges and other intangible or consequential losses that might be claimed as a result of the failure of any part or product. Nor shall ARK Design be liable for injury or any damages to any persons or property resulting from the misuses or improper installation of any part or product subject to this warranty. There are no other warranties either expressed or implied, which extend beyond those set forth in the preceding paragraphs.

THE 18 MONTH WARRANTY PERIOD.

RETURN POLICY

A return merchandise authorization number (RMA#) is needed for all returns. The product must be new, unused, uninstalled, and in its original factory packaging (including all price tags, accessories, materials that are components of the item(s) being returned, instruction manuals, and literature included in the box) in sellable condition to be authorized for return. Returns must be made within 30 days of date of original receipt of sale.
Please fill out the form below to obtain a RMA#. Returns will not be accepted without a Return Merchandise Authorization Number. Returns must be sent via prepaid freight with the RMA# clearly marked on the box. Insurance is frequently not included in shipping of packages. We highly recommend you purchase additional insurance when shipping packages back to ARK Design, as we will not be responsible if the package is not delivered or if it is delivered in damaged condition.

Once the package is received, we will check the box to make sure that the item is in re-sellable condition and that all original materials and packaging was included. Once this has been established, a credit will be issued in the same form of payment that was received, minus a 25% restocking fee on all returns. Original shipping and handling charges are non-refundable. Please note that overnight and 2-day shipping charges will not be refunded.

Items that have been customized, custom ordered, or special ordered may not be returned or exchanged.

EXCHANGES

In order to exchange a product, a Return Merchandise Authorization number (RMA#) is required. Please fill out the form and request an RMA#. The product must be new, unused, uninstalled, and in its original factory packaging (including all price tags, accessories, materials that are components of the item(s) being returned, instruction manuals, and literature included in the box) in sellable condition to be authorized for exchange. Exchanges must be made within 30 days of date of original receipt of sale.

If the exchange is for the same product, no restocking fee will apply. Additional shipping charge for the new product will apply. All shipping charges must be paid before the exchanged product will ship.

If the exchange is for a different product, the item will be treated as a return and the new product will be treated as a separate order. Please note that a 25% restocking fee will apply to exchanges for different products that are less than the original order amount.

To make an exchange, please return the original item by following the return instructions above and place a NEW ORDER for the new items you wish to receive. We will issue a refund to your credit card after we receive your return, and we will make a separate charge for the new order. SHIPPING POLICY

Products will ship within 48 hours of placing the order. In the event an item is out of stock or backordered, we will let you know so that you may decide to keep the item backordered or to cancel the order.

All orders are considered complete and delivered upon leaving ARK Design warehouses. Packages are carefully checked and are shipped insured for the customer’s benefit. Before accepting delivery of the package, we recommend you inspect it for any visible sign of damage to package. Upon accepting delivery of the package, merchandise should be immediately checked for damage and if found, the customer should immediately file a claim with the courier.

International orders are shipped with customs due. ARK Design shipping prices DO NOT include any customs or duties. You are solely responsible for any customs duties, foreign taxes or any additional fees that your country may assess. ARK Design is required by U.S. law to declare the exact value of all items ordered and to mark them as dutiable "merchandise." ARK Design is not liable for any violation on import restrictions and we recommend that you check your country’s import restrictions to ensure that the product you order is legal for import into your country.
